Introduction to EPR
Extended Producer Responsibility (EPR) is required for Indian manufactured or imported products for the management of plastic waste, battery waste and E-waste.EPR Authorization is granted by the CPCB( Central Pollution Control Board ), of the MoEFCC, Government of India.
Every manufacturer of electronic or electrical equipment, plastic packaging, or batteries is required under EPR, or Extended Producer Responsibility, to send the waste created to a authorized dismantler or recycler to guarantee that the waste is treated in an ecologically responsible manner.
EPR has been broken down into the subsequent three categories:
- Electronic Waste Management(e-waste)
- Plastic Waste Management
- Battery Waste Management
1. Electronic Waste Management(e – waste) – The E-Waste (Management) Rules, 2022 were added by the Central Government in accordance with the authority granted by Sections 6, 8, and 25 of the Environment (Protection) Act of 1986 and in replacement of the E-Waste (Management) Rules, 2016. These new rules were published by the Government of India in the Ministry of Environment, Forest, and Climate Change and made available to the Indian public on May 19, 2022, in the Indian Gazette. They become effective on April 1st, 2023. These regulations apply to every manufacturer, producer, refurbisher, dismantler, and recycler who produces, sells, transfers, buys, refurbishes, dismantles, recycles, or otherwise processes any electrical or electronic equipment listed in Schedule I, including the parts, consumables, spares, and components needed to keep the equipment operational.
2. Plastic Waste Management – The Central Government established new regulations called as the Plastic Management Rules, 2022 in order to carry out the authority granted by sections 3, 6, and 25 of the Environment (Protection) Act of 1986 and to replace the Plastic Waste Management(Amendment) Rules of 2016.These rules became effective on July 1,2022.Their recommendations apply to plastic packaging.Producer, Importer, and Brand Owners (PIBO) are given Extended Producer Responsibility under the Plastic Waste Management Rules, 2022.
- Plastic packaging producer (P)
- Importer (I) of all imported plastic packaging and imported product packaging.
- Brand Owners (BO) include supermarkets, retail chains, and online marketplaces in addition to micro and small businesses.
3. Battery Waste Management – The Battery (Management & Handling) Rules, 2001 have been repealed by the Battery Waste Management Rules, 2022 (BWM Rules, 2022), which were announced by the Ministry of Environment, Forestry, and Climate Change on August 22, 2022. BWM Rules, 2022. It applies to all types of batteries, regardless of chemistry, form, volume, weight, material composition, or usage.The following producers are subject to this rule:
- Manufacturing and selling batteries under its own brand, including batteries that have been repaired and used in equipment.
- Sale of batteries, including reconditioned batteries used in equipment, manufactured by other makers or suppliers under their own brand
- Import batteries and battery-containing devices.

Who requires an EPR Authorization?
Producers, importers, brand owners, and manufacturers all have the option of applying for an EPR licence in India. In India, all producers and importers of product waste are required to get an EPR certification. The EPR certification is required for domestic producers or importers of electronic and electronic equipment, batteries, and plastic packaging under the EPR authorization.
Process for EPR authorization
The steps below must be followed in order to submit an application for EPR authorization in India for manufacturers of batteries, electrical goods, and other comparable products:
- Generate an EPR plan – The manufacturer is required to develop an EPR plan outlining how they will collect and recycle their products after their useful lives are over. The EPR strategy should detail the kinds and quantities of waste that will be gathered and recycled, as well as the methods used to do so and the deadlines by which these objectives will be met.
- Complete the application – On the website of the Central Pollution Control Board, where the producer’s production facility is situated, complete the application for EPR Authorization.
- Include necessary paperwork – The producer must submit the EPR authorization application form and the necessary documents.
- Submit the application – The producer must submit the EPR authorization application form along with all required supporting evidence to the Central Pollution Control Board , depending on where their manufacturing plant is situated.
- Await permission – The CPCB may want further information after assessing the EPR authorisation application. After the application is approved, the producer will receive the EPR approval certificate.
It is important to keep in mind that the EPR permission must be renewed on a regular basis in compliance with the regulations set out by the CPCB.
