Overview of EPR Authorization in Plastic Waste Management

Any entity introducing plastic packaging into the consumer market is subject to Extended Producer Responsibility. By implementing EPR, the entity must manage plastic packaging in an environmentally sound manner until they reach their end of life.In Plastic Waste Amendment Rules 2022, the Ministry of Environment, Forestry and Climate Change (MoEF&CC) provides detailed instructions on how the Central Pollution Control Board (CPCB) grants EPR Authorizations for recycling and other activities (waste to energy, waste to oil, and industrial composting) to producers, importers, brands owners (PIBO) and plastic waste processors.

All entities producing pre- and post-consumer plastic packaging waste must comply with EPR Authorization to promote the reuse, recycling, and end-of-life disposal of recycled plastic. Registration with CPCB, SPCB is essential. Registration from CPCB is required for PIBOs operating in more than two states or UTs. Before production can begin, an EPR Authorisation must be obtained. A PIBO must submit Form I and an Action Plan deemed appropriate under the Environmental Protection Act, 1986, and meet all prerequisites according to the latest guidelines listed under the Plastic Waste Management (PWM) (Amendment) Rules, 2022.

Applicability

For plastic waste management EPR provisions in India, the following entities must register with
the Central Pollution Control Board (CPCB) through the portal.

1. Packaging producer P(Producer)
2. Plastic packaging importer I(Importer)
3. Other than micro and small businesses, BO (Brand Owners)
4. Processors of plastic waste engaged in-

  • Recyclables
  • Energy from waste
  • Oil from waste
  • Composting in industry

Process of Registration to CPCB (Central Pollution Control Board)

EPR Authorization for Plastic Waste Management can be obtained by the following process –

  1. We will submit the file to the concerned SPCB/CPCB department.
  2. Attaching all required documents will be our priority.
  3. Coordinating with the appropriate authorities
  4. An authorization certificate shall be issued if the officials find the application and
  5. documents satisfactory. We will take the necessary steps to obtain the EPR
  6. authorization if there is any objection

Required Documents for EPR Authorization Process

To obtain EPR Authorisation for Plastic Waste Management Business, you will need the following documents:

  1. Copies of PAN and Aadhar Card (For Authorized Persons) with sign and stamp
  2. Company Mail ID
  3. MSME
  4. Authorized Person Signature (Jpeg.)
  5. Contact Number (for OTP)
  6. Select States / UTs in which the Importer is operating
  7. Total Capital Invested in the Project ( Rs in Crores )
  8. Packaging Material Photo
  9. Purchase and invoices for the last two financial years
  10. Total number of container imports in a year.

Post Registration Obligation

The obligations of PIBOs using plastic packaging include the following:

  • Creating an account on CPCB’s centralized EPR portal.
  • Submission of the Plastic Waste Management EPR Action Plan
  • Plastic waste recycling
  • Incorporating recycled content into production
  • Manufacturing with recycled plastics
  • Disposal of end-of-life products
  • Plastics collection and recovery (with the option of engaging PROs)
  • Completing and submitting CPCB annual returns
  • (Plastic credits) Provide proof of certification

Categories of Plastic Packaging covered under EPR

EPR applies to the following plastic packaging categories-

  • Category I- Rigid plastic packaging 
  • Category II- Flexible plastic packaging of single layer or multilayer (more than one layer with different types of plastic), plastic sheets or like and covers made of plastic sheet, carry bags, plastic sachet or pouches.
  • Category III- Multilayered plastic packaging (at least one layer of plastic and at least one layer of material other than plastic).
  • Category IV- Plastic sheet or like used for packaging and carry bags made of compostable plastics.

Banned Plastic Articles in India

Items banned include earbuds with plastic sticks, balloon sticks, plastic flags, candy sticks, ice cream sticks, polystyrene (Thermocol) decorations, plates, cups, glasses, cutlery, straws, trays, plastic wraps or packaging around sweet boxes, invitation cards, cigarette packets, plastic banners less than 100 micron, stirrers, etc

The Plastic Waste Management Amendment Rules 2021 prohibit manufacturing, importing, storing, distributing, selling, and using plastic carry bags with a thickness of fewer than 75 microns and a thickness of less than 100 and twenty microns with effect from 31st December 2022

Roles and Responsibilities of PIBOs (Rule 9)

Roles of producers, importers & brand owners-

  • CPCB has developed an online portal for PIBOs. Registration certificates shall be issued via the portal, and PIBOs should register in the portal.
  • CPCB or SPCB shall receive annual reports on the plastic packaging waste collected and processed towards fulfilling obligations under EPR from PIBOs.
  • PIBOs must register or renew registration under the Plastic Waste Management Rules, 2022, which covers the registration tenure, by submitting an Action Plan containing information on the EPR Target, category-wise, when applicable, via the centralized online portal developed by CPCB. In accordance with clauses 4 (i) and 4 (ii), BO must provide details of plastic packaging purchased from producers and importers.
  • Producing companies and importers covered by the abovementioned clauses will keep records of the quantity of plastic packaging material they provide BOs. Producers and Importers will record such sales separately, including category-wise quantities sold. If such records are not kept, they must fulfil the Extended Producer Responsibility obligation. Online platforms shall cross-check transactions reported by PIBOs.
  • The Producers, Importers & Brand-Owners may operate deposit refund systems or buyback schemes to develop a separate waste stream for collecting plastic packaging waste to fulfil EPR obligations. Hence, plastic packaging waste won’t mix with solid waste.
  • CPCB or concerned SPCB or PCC shall receive annual reports on the plastic packaging waste collected and processed towards fulfilling obligations under EPR from PIBOs. Packaging information will also include reused and recycled content. A list will also be provided of the registered recyclers from whom the recycled plastic has been sourced.

Responsibilities of producers, importers & brand owners-

  • Producers shall develop waste collection modalities within six months of publication of these rules, using EPR and involving State Urban Development Departments, individually or collectively, via their distribution channels.
  • PIBOs who introduce products to the market are responsible for collecting multilayered plastic bags and pouches. To collect plastic waste from their products, they need to set up a collection system.Applicants for Consent to Establish, Operate or Renewal must submit this collection plan. After the notification of these rules, Brand Owners whose consents have been renewed shall submit such plans within one year of the notification and implement them within two years.
  • In two years, multilayered plastics that cannot be recycled will cease to be manufactured and used.
  • When six months have passed since the final publication of these rules in the Official Gazette, producers shall not manufacture or use plastic or multilayered packaging for packaging commodities without registering with the State Pollution Control Board or the Pollution Control Committee concerned.
  • When producing carry bags, plastic sheets, or multilayered packaging, producers must keep track of who supplies the plastic.

Cancellation and Renewal Process of EPR Authorization

  • New registrations are valid for one year, and renewed registrations are valid for three years.
  • Registration renewal applications must be submitted four months before the expiration date.
